HEALTH SERVICE ADMINISTRATION AND REGULATION PROCLAMATION

WHEREAS, it is necessary to establish an accountable, quality and accessible health service delivery system through putting in place a national standard of health service;

WHEREAS, it has become necessary to establish a system that meets the health need of the public by modernizing the country’s health service provision;

WHEREAS, it has become necessary to conduct a legislative reform that enables to make the country’s regulatory system on health and health institution; health professionals; as well as health related institutions effective, efficient and uniform;

WHEREAS, it has become necessary to establish a standard of procedures in which a

research activities that improve the health service system could be conducted and implemented;

WHEREAS, it has become necessary to improve the client’s safety, quality, equitable and

accessibility of the health and health related service through establishing a health information system and ensuring information-based decision making.; Health Service Administration and Regulation Proclamation No.1362/2024.

NOW, THEREFORE, in accordance with Article 55 (1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows: Health Service Administration and Regulation Proclamation No.1362/2024

PART ONE

GENERAL PROVISIONS

1. Short Title

This Proclamation may be cited as “Health Service Administration and Regulation Proclamation No. 1362/2024”.

2. Definition In this Proclamation, unless the context otherwise requires:

1/ “Health“ means a state of complete physical, mental, and social well-being, and not merely the absence of disease or infirmity;

2/ “Health Service” means service of disease prevention, treatment, recovery and rehabilitation, health promotion, or hospice care;

3/ “Health Institution” means any institution registered and granted certificate of competency by the Ministry or any Appropriate body to provide health services; and includes Institutions providing Complementary or Alternative Medicine and Traditional Medicines;

4/ “Health Related Institution” means any public service institution including educational institutions, prisons, Refugee camps and pensions, airports, places of worship, child care centers, geriatric centers, market places, gymnasium, massage parlors, hot water service centers, beauty salons, and other similar institutions;

5/ “Mental Health” means a state of mental well-being that enables people to cope up with life’s challenges, realize their potential, learn and work properly, and contribute to their communities;
